Adriahost Terms of Service

I – GENERAL PROVISIONS

These Terms of Service regulate the rights and obligations related to the use of information society services provided by the company Adriahost d.o.o. Beograd-Savski Venac, located at Kneza Miloša 62, 11000 Belgrade, company registration number: 20817534, VAT number: 107508261 (hereinafter referred to as: Adriahost). Adriahost provides services both through the service located at the Internet address [http://www.adriahost.rs](http://www.adriahost.rs) and other addresses managed by Adriahost, as well as by leasing servers (hosting), whether accessed via the Internet or mobile applications (hereinafter referred to as: Services).

Article 2

These Terms of Service are an integral part of the Service and represent the provisions of the contract concluded between Adriahost and each individual who accesses the service or Services, regardless of whether they are a visitor or a registered user of the Service. Adriahost allows the use of the Service exclusively in the manner and under the conditions described in these Terms of Service.

Article 3

By accessing or using the Adriahost Service, the individual agrees to the Terms of Service, thereby concluding a contract by access with Adriahost as the provider of information society services.

These Terms of Service apply to each individual access to the Services.

Article 4

The operations of Adriahost through the Service are primarily regulated by the Law on Electronic Commerce, the Law on Obligations, the Law on Copyright and Related Rights, the Law on Trademarks, the Law on Personal Data Protection, as well as other regulations of the legal system of the Republic of Serbia in parts not regulated by the aforementioned laws.

Article 5

Adriahost is dedicated to the preservation and application of personal rights, privacy, data protection, and copyright, all according to the rules of the information profession, good business practices, and in accordance with the applicable regulations of the Republic of Serbia.

Article 6

The Services are not a substitute for any other services except those explicitly mentioned in these Terms of Service. Adriahost does not provide or ensure any other services, except for the information society service described in these Terms of Service.

Article 7

Adriahost does not influence the content posted on the service or made publicly available through the Service by users or content created by collecting and distributing publicly available data, nor does it guarantee the accuracy or usability of the information presented through the available content.

The sole responsibility for the content available through the Service lies with the individuals who posted it or from whom the content was obtained.

Article 8

Adriahost has the right, but not the obligation, to remove any content from the service or Service at any time without any prior or subsequent notification or explanation if it deems that there has been a violation of these Terms of Service.

II – DEFINITIONS OF TERMS AND DESCRIPTION OF SERVICES

Article 9

For the purpose of interpreting these Terms of Service, the following terms have the following meanings:

  • “Hosting” is the service of automatic, intermediary, and temporary storage of data entered by users of the service, which, at the request of the user or third parties, are transmitted via a communication network, in other words: the space on the server you have leased, which is on a publicly accessible network where your data can be private or publicly available.
  • “A ticket” is a form of organized electronic communication between the user and Adriahost that takes place within the so-called Ticketing system, which can be sent to Adriahost through the Service, and a copy of the content can be sent via email. A ticket represents a message that the user sends to Adriahost or that Adriahost sends to the user for technical support. The validity, evidentiary strength, or written form of the ticket cannot be disputed solely because it is in electronic form. The ticket produces full legal effect from the moment of its creation.
  • “The Ticketing system” is the only way Adriahost provides technical support to users, representing organized mutual communication through tickets.
  • “User” is any natural or legal person who uses the services of Adriahost for professional or other purposes.
  • “A user account” is a set of data about an individual user necessary for providing Adriahost services, relating to the user and their rights and obligations towards Adriahost. The user account especially contains data about the user’s name and surname or business name, address or headquarters, email address, active products/services provided by Adriahost, recent support tickets, registered domains, and user accounts. Each user accesses their user account by entering a username and password. All data entered by the user in their account is considered absolutely accurate by Adriahost. The user is obligated to regularly update the information in their account and ensure that the data is correct and accurate.
  • “Shared hosting” is hosting with shared server usage, i.e., leasing a server where other users also lease space.
  • “Dedicated server” is the lease of a server whose user is the sole lessee, and where third parties do not lease space.
  • “Audio hosting” is hosting intended for storing and reproducing audio recordings via the Internet from the user’s device (streaming).
  • “Domain registration” is the service of leasing domain names provided by Adriahost in the available domain spaces as an authorized registrar.
  • “A competent authority” is a state body competent to act in a specific case (e.g., court, prosecutor’s office, inspection bodies, etc.) as well as regulatory bodies and over-providers who can conduct proceedings where Adriahost is legally or contractually required to participate.
  • “Spam” has the meaning of an unsolicited message or email as prescribed by the laws of the Republic of Serbia, specifically the Law on Electronic Communications (Article 118), the Law on Advertising (Article 63), and the Law on Electronic Commerce (Article 8).

Article 10

The Service is intended to provide hosting services, domain registration, and technical support services in the field of information technology as defined by these Terms of Service.

Article 11

The information society services provided by Adriahost include:

  • Internet (web) hosting
  • Hosting for business users
  • Cloud – VPS servers
  • Dedicated servers
  • Windows servers
  • Audio hosting
  • Internet domains
  • Domain registration
  • Domain transfer
  • Privacy protection for domain registrants (WHOIS protection)
  • SSL certificates
  • Other services
  • Website migration
  • Website creation
  • SMS marketing
  • Google advertising
  • Additional services for designing, implementing, maintaining, and integrating various IT solutions

Article 12

The content that users post through the Service, regardless of the form and format of the content (text, graphics, photos, audio, video, etc.) must be accurate and correct.

The responsibility for the accuracy and correctness of the entered data lies solely with the individual who entered the data. Accuracy implies that the data comes from a competent source and/or the user’s personal experience. Correctness implies linguistic (spoken language or programming code) and factual correctness.

Article 13

Any use of the Service, in whole or in part, that is not in accordance with these Terms of Service will be considered a violation of the Terms of Service.

The misuse of services provided by Adriahost is prohibited.

Article 14

Adriahost transmits electronic messages submitted by users of information society services but does not in any way: initiate their transmission, select the data or documents transmitted, exclude or change the data in the content of the messages or documents, or select the recipient of the transmission.

Article 15

Adriahost reserves the right to modify or discontinue (whether temporarily or permanently) any element of the Service, the services it provides, as well as its own content or entries, regardless of the author of the element of the Service, and without prior approval or notification, in accordance with good business practices.

Article 16

All time determinations and deadlines displayed through the Service, as well as the time zone and working days, are calculated according to the applicable regulations of the Republic of Serbia.

Article 17

The user pays the price of the information society service before the service is provided.

The user can pay the service price to Adriahost only through available payment methods, i.e., only in ways accepted by Adriahost.

Article 18

Adriahost can provide additional services to each user individually that are not defined by these Terms of Service, concluded through a separate contract defining those additional services.

Article 19

Adriahost will fully support the protection of personal rights, privacy, property rights, and intellectual property rights of all rights holders or those whose rights have been violated by, without delay:

  • removing content from public availability upon a reasoned request, supported by appropriate documentation, and preserving the same content for evidentiary purposes,
  • providing information about the user whose input violates any of the aforementioned or other rights to the competent authority upon request.

Article 20

When providing information society services, Adriahost is not obliged to review the data it has stored, transmitted, or made available, nor to examine circumstances that would indicate illegal actions by the User.

The notice of illegal activity or data must contain information about the sender, a precise description of the location on the website, or other electronic display where the illegal data appears, and a justification of the illegality.

Article 21

Adriahost is obliged to present all data based on which the detection or prosecution of criminal offenses or the protection of third-party rights can be undertaken, based on an appropriate court or administrative act.

III – USERS

Article 22

Users of the services provided through the Service by Adriahost are considered both visitors and registered users.

Article 23

A visitor is an individual who accesses the service or Services via

the Internet in the sense of these Terms of Service without registering or logging into the service or Services.

A visitor is not required to pay any fees to Adriahost.

Article 24

A registered user is a legal or natural person who has registered on the service or Services under the conditions and in the manner described in these Terms of Service.

Only registered users can use Adriahost’s services according to the available Service functions for which they have previously paid a fee.

Article 25

Adriahost does not moderate, modify, or in any way influence the registration process or the content posted on the service or Services by the registered user, and the registered user has exclusive responsibility and bears all legal consequences that may arise from such content.

Adriahost has the right to verify the correctness of the registration data and correct it in accordance with the law regulating accounting.

Article 26

The user receives an automatically generated password at registration on the registered email address, which they can change at any time, and is solely responsible for the confidentiality of the password and the use of the Service through the access data.

The user can request a reminder related to the access data from Adriahost, and it will be sent exclusively to the email address provided in the user account. Adriahost does not provide other forms of reminders for access data.

Article 27

The registered user retains all copyrights and related rights to the content they have created. The registered user guarantees that they are the owner or user of all necessary copyrights on the entire content and all its individual parts that they post on the service or Services. The registered user is solely responsible for any violations of copyrights or related rights, as well as other intellectual property rights.

The registered user can simultaneously post different content. Posting content on the service or Services does not limit the registered user from posting or publicly communicating the same content elsewhere. The registered user can delete or modify the content they have posted without any explanation or notification at any time. Adriahost will delete or modify such content immediately, except for content found in system-generated backups over which Adriahost has no control.

By posting content on the service or Services, the registered user unconditionally and irrevocably authorizes Adriahost to transfer the content to an indefinite number of persons and to remove the content without prior or subsequent notification or explanation.

Article 28

With each individual login to the service or Services, the registered user gains access to their account on the service or Services and the ability to post content. The registered user can make adjustments according to the available Service options.

Security Obligations of Users

Article 29

The user agrees to apply appropriate security measures when using the Services.

The user can notify Adriahost if they suspect unauthorized use of their access data.

If the User gives their access data to a third party (e.g., webmaster, representative, authorized person, designer, accountant, etc.), the User is responsible for the actions taken by the third party.

In certain cases limited to providing technical support, Adriahost may request a password from the User, and the User agrees to change the password immediately after the provided support.

The user is obliged to monitor their own content and notify Adriahost without delay if they notice changes in the content that they did not independently initiate or approve.

The user is obliged to keep their software up-to-date when using the Service to prevent the misuse of security vulnerabilities in outdated versions.

IV – COMMUNICATION AND USER NOTIFICATIONS

Article 30

The user agrees that Adriahost may periodically send notifications regarding the Service content, as well as notifications concerning the Service, including promotional messages from Adriahost.

Article 31

Adriahost will promptly notify the user of the expiration of the hosting service by sending notifications exclusively to the contact information listed in the user’s account at the time of notification.

If the user fails to renew the service by the hosting expiration date, Adriahost will consistently apply the rules related to the termination of the hosting service defined in these Terms.

Article 32

In accordance with these Terms of Service, Adriahost provides the following notifications regarding Internet hosting services and Internet domains:

  • Notifies the user 30 days before the service expiration by sending a specific notification about the expiration of the Internet domain and a list of Services expiring within 30 days along with the corresponding proforma invoice. Additionally, users are notified about the expiration of these services by sending an SMS message from Adriahost, if the user has enabled SMS notifications in their account settings.
  • Notifies users who have not made payment after the previous notification 20 days before the service expiration by sending a Payment Reminder to the user’s email address.
  • Notifies users who have not made payment after the previous notification 15 days before the service expiration by calling them through Adriahost’s Sales department call center to verify receipt of the previously sent email notifications and the accuracy of the user’s account data.
  • Notifies users who have not made payment after the previous notification 10 days before the expiration of the Internet domain by sending a specific notification about the expiration of the Internet domain within 10 days to the user’s email address.
  • Notifies users who have not made payment after the previous notification 1 day after the service expiration by sending a specific notification that the services have expired to the user’s email address.
  • Notifies users whose services have expired 7 days after the service expiration by sending a suspension notification to the user’s email address. Additionally, users are notified about the suspension of the service by sending an SMS message from Adriahost, if the user has enabled SMS notifications in their account settings.
  • Notifies users whose services have expired 14 days after the service expiration by calling them through Adriahost’s Sales department call center to check if the user wants to renew the services.

Adriahost ceases to notify the user about the expiration of each individual service if the user makes the corresponding payment for those services or unequivocally confirms that they do not wish to renew the service.

In accordance with good business practices, Adriahost will attempt to contact the user by all available means (e.g., through social networks) to prevent any undesired consequences for the user and user data due to communication lapses via email or phone.

V – GENERAL RULES FOR USING SERVICES

Article 33

The user pays the fee for using the Service according to the proforma invoice issued by Adriahost for the services they wish to use. Each individual proforma invoice is valid for 30 days from the date of issuance, and if payment is not received within that period, it will be considered that the user does not want the service for which the proforma invoice was issued.

Adriahost issues an invoice and provides the services only after receiving the full amount for those services. The start date for providing certain services (such as IP address lease and server lease) is subject to the duration of the procurement process for those services, and Adriahost does not commit to performing them within a specific period.

Article 34

The user is solely responsible for selecting Adriahost services, their scope, and the manner of use. After 30 days from the payment date, Adriahost will not refund money or exchange the service if the paid service does not meet the user’s needs for any reason.

Article 35

Adriahost will promptly notify the user of the expiration of specific services they use by sending notifications exclusively to the contact information listed in the user’s account at the time of notification.

If the user fails to renew the service by the date paid for, Adriahost will cease providing the service the next day, in accordance with these Terms.

Article 36

Adriahost reserves the right to deny the use of the Service (whether individually or entirely) to any user, at its discretion.

Adriahost reserves the right to discontinue providing the Service to users who, at its discretion, do not meet the standards Adriahost is committed to, especially those who fail to meet their contractual obligations in a timely manner.

Article 37

Users agree to comply with the restrictions listed here regarding unauthorized use of others’ accounts, computers, or networks; sending unsolicited email; posting unauthorized scripts or applications; misuse or excessive use of shared resources; posting unauthorized content; and adhering to their security obligations.

Unauthorized Use of Others’ Accounts, Computers, or Networks

Article 38

These Terms prohibit the user from using or attempting to use someone else’s account, computer, or computer network without authorization. This includes attempts to prompt others to disclose their access parameters or personal data, cracking passwords, network scanning, looking for security vulnerabilities, etc.

For any misuse or attempted misuse of the Service or user account, Adriahost’s computer or network, whether performed on Adriahost’s computers or network, via Adriahost’s user account, or otherwise, Adriahost will suspend or terminate the Service and file an appropriate report with the competent authority.

The following are examples, without limitation, of user activities prohibited on the service or Services:

  • Requesting personal information from any individual, regardless of age
  • Requesting access parameters for Services
  • Requesting passwords or information identifying individuals for unauthorized purposes
  • Impersonating or attempting to impersonate a legal or natural person
  • Impersonating or falsely representing a connection with a person, through pre-sent text or other forms of social engineering or other forms of fraud
  • Selling or transferring a user account in an unauthorized manner
  • Using another user’s access data or username at any time or disclosing the password to third parties or allowing third parties to access an account that is not theirs.

Unsolicited Electronic Mail – “Spam”

Article 39

These Terms prohibit the user from participating in any actions that can be classified as Spam.

For any sending of Spam or attempting to send Spam via the user account, Adriahost’s computer or network, or otherwise, Adriahost will suspend or terminate the Service and file an appropriate report with the competent authority.

The following are examples, without limitation, of user activities prohibited on the service or Services:

  • Including the transmission of unsolicited mail, chain letters, or mass mail, instant messages, or “spam.”
  • Collecting or storing personal data about other users without their explicit consent
  • Advertising or offering any products or services via unauthorized or unauthorized sales methods.

If the sending of Spam or participation in sending Spam leads to financial consequences such as the costs of express removal from the blacklist of the competent RBL (Realtime Blacklist) body or costs imposed on Adriahost, the full financial compensation will be borne by the service user. The user’s services will be suspended until financial obligations on this issue are settled.

Unauthorized Scripts or Applications

Article 40

Users of Internet hosting services on a shared server are prohibited from hosting Proxy servers (nph-proxy, cgi-proxy, etc.), IRC servers, or any applications and scripts that require significant server or network resources and thus exceed the capabilities of shared hosting, which by their technical nature require a separate, dedicated server. This prohibition exists due to the possibility of excessive load on the shared server, which jeopardizes the rights of other users of that server.

The following are examples, without limitation, of user activities prohibited on the service or Services:

  • Bypassing or modifying, attempting to bypass or modify, or encouraging or assisting others to bypass or modify any security technology or software that is part of the Service.
  • Falsifying TCP/IP packet headers or any part of header information in any posting or otherwise using the Service to send altered, deceptive, or false information identifying the source.
  • Engaging in activities that involve using viruses, bots, worms, or other computer codes, files, or programs that disrupt, destroy, or limit the functionality of computer software or hardware, or otherwise allow unauthorized use or access to a computer or computer network.
  • Interfering with any user’s, host’s, or network’s access to the service or Services.
  • Covering or obscuring advertising through banners or other graphical elements on the profile page of the user or any page of the Service through HTML/CSS or otherwise.
  • Including HTML, CSS, or other coding, including but not limited to all hidden or otherwise secretly contained codes in submitted content that are not related to the nature of the submitted content.
  • Any automatic use of the system, such as but not limited to using scripts for uploading images or videos.
  • Attempting to probe, scan, or test the vulnerability of any part of the Service or breach any security measures or measures for verifying identity.
  • Using meta tags or other hidden text or metadata using the names, trademarks, URLs, or product names that belong to Adriahost without prior express permission from Adriahost.

Misuse or Excessive Use of Shared Resources

Article 41

Users of Internet hosting services on a shared server are prohibited from hosting or storing large amounts of data or creating a “public” FTP server or processing large amounts of data, as this exceeds the capabilities of shared hosting, and by their technical nature requires a separate, dedicated server.

The user is obliged to ensure that using the Service does not send data or requests for data that significantly exceed usual levels and can cause congestion on servers, networks, and other services. This also includes excessive requests from third parties towards the provided hosting service, i.e., towards Adriahost servers.

Excessive load on shared resources will be considered an average daily load or maximum daily load on the processor, network resources, amount of memory used, or number of requests to the web server or database server within one day or several consecutive days, which is ten times higher than the use of an average user of an equivalent hosting service at Adriahost.

The user is obliged to pay for exceeding the monthly bandwidth.

Excessive use of shared hosting will be considered the use of inodes over 500,000 inodes (files), which activates soft-limit measures on the account for 7 days, during which the client has time to reduce the usage, while exceeding and using over 600,000 inodes (files) will trigger a hard limit, completely preventing new inode writes to disk until the user reduces the usage or switches to infrastructure that allows greater or uncontrolled inode use.

Adriahost will suspend the user’s services if they do not comply with the following size, number, and file type limitations:

  • Video and audio files: a maximum of 2,000 files, each of which must not exceed 5 MB in size.
  • Documents (doc, pdf, and similar files): a maximum of 4,000 files, each of which must not exceed 5 MB in size.
  • Images and graphic files (tiff, png, psd, jpg, gif, and similar files): a maximum of 4,000 files, each of which must not exceed 5 MB in size.
  • Archives and log files (zip, rar, tar, tar.gz, 7z, and similar files): a total of 12 GB, with Adriahost reserving the right to delete these files if they occupy more than 12 GB of space without informing the user.

If the user does not remove the files to comply with the limits and does not respond to Adriahost’s warnings for more than 30 days, Adriahost reserves the right to terminate the account and delete the data.

The following are examples, without limitation, of user activities prohibited on the service or Services:

  • Creating unnecessary loads on the Service.

Unauthorized Content

Article 42

Users are prohibited from posting content that includes (but is not limited to):

  • Offensive content or content promoting racism, intolerance, hatred, calls for violence, or harm to any group or individual, or harassment or calls for harassment.
  • Exploiting people in a sexual or violent manner.
  • Publicly posting information that constitutes or creates a risk to privacy or security.
  • Containing or promoting information that is known to be false or misleading, or promoting illegal activities.
  • Engaging in unregistered commercial activities requiring registration with a state body.
  • Encouraging or promoting criminal activities or enterprises or providing instructions for illegal activities.
  • Violating copyrights, trademark rights, patents, or other intellectual property rights.
  • Committing a criminal offense, including child pornography or other illegal content, fraud, Ponzi schemes, sending viruses, or other harmful files, copyright infringement, patent infringement, or trade secret theft.
  • Using information obtained from the Service to harass, abuse, or harm someone and attempting to do so.
  • Unauthorized commercial advertisement on the user profile or accepting payment or anything of value from third parties in exchange for performing commercial activities through unauthorized or prohibited use of the Service on behalf of that person.
  • Deleting or otherwise altering copyright, trademark, or other proprietary rights notices appearing on user content unless it is content the user has posted.
  • Using the Services in a manner inconsistent with any applicable laws and regulations, or violating the Services or network security.

Violation of Terms of Service

Article 43

Adriahost reserves the right, but not the obligation, to monitor all user activities and user content related to the Service. Adriahost may investigate reported violations of its Terms of Service and other reports and may take any legal or technical actions it deems appropriate. Adriahost will investigate circumstances that may involve such violations and may call upon and cooperate with competent state bodies during the identification, investigation, or prosecution of individuals involved in such violations of the Terms of Service or the law.

Adriahost retains the discretionary right to use all legal remedies, including but not limited to removing the user account and user content and immediately suspending all Adriahost services the user uses in the event of any violation of these Terms or if Adriahost cannot verify or check any information the user sends to Adriahost.

Article 44

Adriahost reserves the right, but not the obligation, to apply the following procedure in its relationship with users in case of violation or suspicion of violation of these Terms of Service and/or the law:

Standard Complaint

Adriahost will, after receiving a complaint (abuse notice) from any party (most often: data center, Enom, RNIDS, or third-party security companies), verify the allegations of the complaint, contact the User, and order them to rectify the irregularity in the complaint within 24 hours.
If the User from point 1 does not rectify the irregularity within 24 hours from the moment the rectification order is sent or is not available, Adriahost will suspend the service containing or causing the irregularity. The suspension will last until the User informs about the rectification of the irregularity.

Urgent Complaint

If the complaint requires urgent action (e.g., active phishing, child pornography, DMCA request regarding copyright), Adriahost will immediately suspend the service containing or causing the irregularity and inform the User.
The suspension will last until the irregularity is rectified.
Adriahost will work actively with the User to rectify the irregularity.

One-hour Complaint

If Adriahost receives a complaint from an over-provider with a one-hour timeframe for action, Adriahost will:

  • Archive the content in .zip format (to allow the User to subsequently rectify the irregularities)
  • Suspend the hosting until the irregularities are rectified.
  • The suspension will last until the irregularities are rectified.
  • Adriahost will work actively with the User to rectify the irregularities.

Suspension due to Repetition

In case the same or another irregularity is found with the same User for the second time, Adriahost will suspend the Service for a period until the Client contacts, but not less than 48 hours. Adriahost will work actively with the User to avoid repetition of irregularities.

In case the same or another irregularity is found with the same User for the third time, Adriahost will immediately stop providing all services to that

User without the possibility of a refund for any of those services, with the explanation: Violation of Terms of Service.

If the User’s activities cause material damage to Adriahost (regardless of the type of damage), Adriahost reserves the right to directly charge the User the amount of the damage at double the value of the Services or initiate proceedings for compensation before the competent authority.

In case of damaging Adriahost’s reputation by the Client, Adriahost reserves the right to stop further business with that Client and offer the possibility to move their hosting and domains to another provider within 14 days.

Notifying the User in accordance with this article is done by sending a specific notification about the complaint or suspension to the User’s email address. Additionally, the User is notified by sending an SMS message from Adriahost, if the User has enabled SMS notifications in their account settings.

VI – REGISTRATION, TRANSFER, AND RENEWAL OF DOMAINS

Article 45

Adriahost, as an authorized registrar, is obliged to apply the rules governing the registration of each domain space individually.

The User agrees to independently inform themselves about the rules applicable to the domain space for which they are the registrant, i.e., ICANN rules and RNIDS rules.

Article 46

The User is solely responsible for choosing the domain name, domain space, and the use of the registered domain.

Adriahost will not refund money or change the domain name or domain space if the paid domain does not meet the user’s needs for any reason.

The User pays the fee for domain registration according to the proforma invoice issued by Adriahost for the domain names they wish to register.

The User agrees to check the proforma invoice before payment to ensure that the domain name is correctly listed, and if it is not, to notify Adriahost (also before payment) with a request for correction. If the domain name is taken in the meantime, before the payment is recorded, the User can choose to register another domain name or request a refund.

The domain will be registered to the User whose payment is first recorded. Payment recording is done as follows:

  1. Automatically for credit card payments and IPS payments through the bank account,
  2. For payments via bank account, the user can send proof of payment (scanned receipt) for faster recording on business days during working hours,
  3. All other payments via bank account are automatically recorded if the correct User data and reference number are provided,
  4. All other payments via bank account without the correct User data or reference number are manually processed once a day on business days.

Adriahost will register the domain name listed in the paid proforma invoice.

The contract is considered concluded only after the User receives confirmation from Adriahost via email about the registered domain after payment. Payment based on this proforma invoice/order does not obligate Adriahost to register the requested domain.

Adriahost issues an invoice and provides the domain registration service only after receiving the full amount for domain registration. If the domain is not available for registration and the system has already issued an invoice, the invoice will be corrected or canceled, and the money refunded to the user.

Changes to the domain registrant’s data are not made by paying the proforma invoice or Adriahost’s invoice but exclusively through the procedure for changing data for that domain.

Article 47

The User pays the fee for domain transfer according to the proforma invoice issued by Adriahost for the domain names they wish to transfer. Transfers within the domain space assigned to the Republic of Serbia are free when transferring to Adriahost.

The fee for transferring international domain spaces includes Adriahost’s support services for that transfer and the first year of registration for the individual domain from the date of transfer completion.

Domain transfers cannot be made within 60 days of initial registration or within less than 30 days before the registration expires. Transfers within the domain space assigned to the Republic of Serbia are performed without time restrictions.

Article 48

Adriahost will promptly notify the user of the expiration of domains for which they are the registrant, by sending notifications exclusively to the contact information listed in the user’s account at the time of notification.

Domain renewal is valid from the exact time (hour and minute) of the initial registration date when it expires.

If the user fails to renew the domain by the date the domain is leased, Adriahost will consistently apply the rules related to the additional domain renewal period that apply to that domain space.

Adriahost is not responsible if any domain lease expires due to the user’s untimely actions.

Article 49

Adriahost reserves the right to deny the registration of any domain to any individual user at its discretion.

Adriahost reserves the right to stop providing domain renewal services to users who, at its discretion, do not meet the standards Adriahost is committed to, especially those who fail to meet their contractual obligations in a timely manner.

VII – HOSTING SERVICES, EXTENSION, AND TERMINATION OF HOSTING

Article 50

Adriahost, as a provider of hosting services, is obliged to apply all relevant rules governing the hosting of user content.

The User agrees to independently inform themselves about the rules applicable to the content they host and to apply them.

Article 51

The User is solely responsible for choosing the type of hosting or hosting package and the manner of using the hosting service.

After 30 days from the payment date, Adriahost will not refund money or change the hosting package if the paid hosting does not meet the user’s needs for any reason.

Article 52

Adriahost makes a backup of data (backup) of all hosted sites once a day on shared hosting.

Adriahost does not make backups on dedicated servers and VPS. The user is responsible for the content they host and can optionally back it up locally or on a remote server independently of Adriahost. Adriahost can provide a Premium backup offer on request.

Adriahost is not responsible for lost or damaged user data or content. The user is solely responsible for all content on the leased hosting and for maintaining and backing it up. The user has the option to make backups using the available Service functionalities (e.g., via cPanel).

Adriahost does not store data or make backups for user accounts larger than 150 GB or 100,000 individual files (inodes).

Adriahost does not make backups for files of the following formats:

  • Archives and file packages: .tar, .tar.gz, .zip, .rar, .7zip, and other similar
  • Logs and error_log files in any format
  • Backups created manually or via CMS plugins
  • Cache files generated by CMS scripts

Article 53

It is the exclusive responsibility of users of content management systems (CMS, e.g., PHP Nuke, Mambo, Joomla, etc.) and all other scripts they post as content on their hosting to monitor developments in the field of security and protection of such systems and scripts, and to remove known vulnerabilities through regular maintenance and application of appropriate patches and/or updates.

If there are undesirable consequences for user content, Adriahost may, but is not obligated to, suspend the user’s hosting and notify them of security measures. If Adriahost informs the user, the user is obliged to implement the specified measures. The user is also obliged to clean any infected files and, after cleaning, contact technical support via a ticket. Only then will the hosting be reactivated. If the user cannot clean the infected files themselves, Adriahost can (but is not obligated) to perform the cleaning for an agreed additional fee.

Article 54

Termination of the hosting service is carried out according to the following rules:

  • Adriahost is obliged to keep the hosting service active for a period of 7 days from the hosting service expiration date, in full scope of that service, regardless of the expiration, except in the case of domain expiration. If the domain has expired, the User can access cPanel and download their content and data via the server name (not the domain, as it has expired) during this period.
  • After the period of 7 days from the hosting service expiration date, the service is suspended, meaning that the user cannot access cPanel, hosted email, or the site itself. Attempting to access cPanel or email will display the message “login failed.” Attempting to access the site will display the message “The website is suspended, call Adriahost.” If the domain has expired, these messages will not be displayed but will show a “timeout” message.
  • Adriahost retains the user’s data and content for 180 days from the hosting service expiration date and, according to good business practices, attempts to contact the User to renew the service.
  • After the period of 180 days from the hosting service expiration date, all data and content are removed without the possibility of recovery unless the data can be retrieved from a backup.

Termination of VPS and Dedicated Server Service

Termination of VPS and dedicated server service is carried out according to the following rules:

  • When the VPS or dedicated server service expires, it is suspended the next day by shutting down the network port, and there is no access to the server via SSH, HTTP, or any other way.
  • Adriahost will, according to good business practices, attempt to contact the User to renew the service within 3 days from the VPS or dedicated server service expiration date.
  • After the period of 3 days from the VPS or dedicated server service expiration date, the service ceases.

Article 55

Adriahost reserves the right to deny hosting service (whether in whole or part) to any individual user at its discretion.

Adriahost reserves the right to stop providing the hosting service (whether in whole or part) to users who, at its discretion, do not meet the standards Adriahost is committed to, especially those who fail to meet their contractual obligations in a timely manner.

VIII – TECHNICAL SUPPORT

Article 56

Adriahost provides technical support exclusively through tickets.

Adriahost does not provide technical support via phone or any other means.

Article 57

Adriahost provides technical support exclusively for services the user uses with Adriahost. Adriahost does not provide technical support for services used with third parties.

Adriahost provides technical support related to the functionality of the hosting (server and script installation) offered by Adriahost (cPanel and Softaculous). This includes support related to script installation from cPanel (Joomla, WordPress, etc.), but does not include support related to their operation, functionality, or customization.

Adriahost does not provide technical support related to the functionality of plugins, modules, and similar add-ons that can be installed later in these scripts (e.g., Joomla, WordPress).

 IX – LIMITATION OF LIABILITY, WARRANTIES

Article 58

Users use the Service entirely at their own risk. The user explicitly accepts that Adriahost cannot be responsible for the behavior of other users or third parties and that the risk of possible damage is borne entirely by those individuals, in accordance with the applicable laws of the Republic of Serbia.

Article 59

Adriahost transmits data entered by Users via a communication network and is not responsible for the automatic, intermediary, and temporary storage, which serves only to form a more efficient transmission of data requested by other users of the service because: it does not alter the data; it respects the conditions for accessing the data; it acts in accordance with the rules for updating data; it operates in accordance with the permitted use of data collection technologies; it removes or disables access to the data it stored immediately after knowing that the data has been removed from the transmission via the network or access to it is disabled, as well as when the court or other competent authority has ordered their removal or disabling of access.

Adriahost stores data provided by Users at the request of Users and is not responsible for the content of stored data because: it does not know nor can it know about the illegal activity of the User or the content of the data; immediately after knowing that it is about illegal activity or data, it removes or disables access to that data.

Adriahost may enable access to data from another service provider via electronic referral (Link), but it is not responsible for that information because: it does not know nor can it know about the illegal activity of the User or the content of the data in that information; immediately after knowing that it is about illegal activity or data, it removes or disables access to the data.

Article 60

Adriahost does not guarantee the accuracy, reliability, or content posted by users. Adriahost does not initiate the transmission of the electronic message submitted by the user, does not select the data or documents transmitted, does not exclude or change the data in the message or document content, and does not select the recipient of the transmission.

Article 61

The limitation of liability applies to all damage (material and/or non-material) or injuries that could arise from hidden defects, errors, interruptions, deletions, malfunctions, delays in operation or transmission of computer viruses, communication interruptions, theft, destruction or unauthorized access to data, alteration or misuse of data by third parties, contract termination, behavior contrary to the Terms of Service, negligence, and others.

Article 62

Adriahost is not responsible under any circumstances if due to the user’s failure to apply available security measures or the user’s failure to clean infected files, any undesirable consequence occurs to any content or if any undesirable consequence occurs due to the user’s omission.

Article 63

Adriahost is not responsible if due to the user’s untimely actions any hosting lease expires or user content is deleted.

Article 64

Except in cases of intent or gross negligence, Adriahost is not responsible for temporary unavailability of the Service, nor for partial or complete malfunction or incorrect functioning of the Service. Adriahost is not responsible for technical problems that may lead to delays and/or incorrect processing of electronic data, including the system clock. Internet service providers used by Adriahost are responsible for the aforementioned. In any case, Adriahost is responsible only and exclusively up to the value of the provided service.

Article 65

The Service may be temporarily unavailable or available in a limited scope as a result of regular or extraordinary system maintenance or in case of system upgrades.

Quality Guarantee and Warranty Limitations

Article 66

Adriahost guarantees 99.9% uptime for leased hosting services on a monthly basis. Uptime refers to the period during which the leased hosting services were available on the internet network but does not include unavailability that the User does not report within 5 days or unavailability caused by planned server or network maintenance, DDoS attacks, and other hacker attacks that cannot be influenced, application failures of the user, actions or omissions of the user, actions of third parties authorized by the user, violation of the Terms of Service, or force majeure.

For every 0.1% of uptime below the guaranteed availability, the user has the right to request free subscription extension for the leased hosting service for one calendar day or equivalent price reduction for the next subscription period. This quality guarantee extension is limited to a maximum of 30 days for unavailability occurring in one calendar month. This does not apply to dedicated servers and virtual (VPS/Cloud) servers. For dedicated and virtual server leases, the User can request a price reduction for the next subscription period as follows:

  • For availability below 99.9%, a reduction of 10% of the current monthly price.
  • For availability below 99%, a reduction of 25% of the current monthly price.
  • For availability below 95%, a reduction of 50% of the current monthly price within one calendar month.

Backups and data preservation of user data are not included in the quality guarantee. Adriahost makes regular and multiple backups of user files and databases and strives to always ensure that automated backups are correct. However, it is not always possible to verify the integrity and availability of automatically generated backups, which is why they cannot be guaranteed.

Adriahost cannot be responsible if user data is damaged or lost, which is why it is recommended that the User regularly creates backups of their data and stores them on their computer or other storage media to ensure data availability. During the subscription period, the User can independently create backups and download content from the server at any time via the hosting control panel or FTP account.

X – COPYRIGHT AND AFFILIATE PROGRAM

Article 67

Adriahost has exclusive copyright and intellectual property rights to its service or Services, as well as all individual elements that constitute it, such as text, visual and audio elements, visual identity, data and databases, program code, and other elements of the service or Services, for which Adriahost is the author or copyright holder.

Article 68

Unauthorized use of any part of the Services or the entire Services without prior express written permission issued by Adriahost as the exclusive copyright holder will be considered a violation of Adriahost’s copyright and is subject to legal action to the fullest extent.

Article 69

The Services may also contain elements for which third parties have exclusive copyright, trademark, and other intellectual property rights, such as user content, aggregated publicly available content, business partner content, advertisers, etc. Third parties are exclusively responsible for the content they own, regardless of the fact that such content is located on or available through Adriahost Services.

Article 70

By posting content on the service or Services (except for the user account), the user agrees that it becomes visible to an unlimited number of third parties, under the conditions and manner described in these Terms of Service. Further transmission of third-party content or parts of the content from any part of Adriahost Services is only allowed with prior express permission from Adriahost, with a note that the content was taken from Adriahost, and a link to the source of the content on Adriahost must be provided.

Article 71

Each individual is solely responsible for the content they have authored or posted and made publicly available through the Service.

Adriahost is exclusively responsible only for the content it has copyright over.

Article 72

Adriahost can establish a cooperation program with Users, known as the Affiliate Program, which allows Users participating in such a program to use benefits or receive discounts on Adriahost Services.

The Affiliate Program operates under special conditions published on the Adriahost website.

Article 73

Adriahost may, at its discretion, promote the sale of all or individual Services defined in these Terms of Service through the Affiliate Program or other means (e.g., promotional code), in accordance with special conditions published on the Adriahost website.

XI – PERSONAL DATA PROTECTION POLICY

Article 74

The Personal Data Protection Policy is an integral part of these Terms of Service.

This Personal Data Protection Policy is a legally binding document through which Adriahost regulates the issue of protecting the personal data of its Users.

This Policy does not produce legal effects between Users and third parties, nor can Users or third parties invoke this Policy in their mutual relations, nor does referencing this Policy produce legal effects in mutual relations between third parties.

Users collecting personal data are required to comply with the Law on Personal Data Protection and independently create their own policy regulating this area, and under no circumstances can Adriahost be considered the Data Controller for such collected data.

Article 75

Adriahost processes the necessary data of those natural persons who have given consent for processing, for a clearly defined purpose, in a manner permitted by law.

Article 76

The data processed must be true and complete and based on a reliable source, or a source that is not outdated.

The user is obliged to provide accurate, truthful, complete, and valid data.

Article 77

Before collecting data, Adriahost, as the Data Controller, informs the individual to whom the data relates about the following:

  • That Adriahost is the Data Controller responsible for collecting the data.
  • That the purpose of collecting and processing the data is to provide the information society service, ensure the security of Service users, and enable the posting of hosted content or the registration of Internet domains in accordance with the law and regulations governing the registration of Internet domains.
  • That the collected data is used in a way that enables the identification of participants in electronic commerce and service users, in accordance with good business practices, confidentiality, and the law.
  • That the individuals who use the data are those employed by Adriahost, authorized to use the data, and individuals with whom the user enters into an obligational relationship to the extent necessary to achieve that relationship, as well as all State bodies that, based on the law and/or court decision, have the right to use the data.
  • That providing personal data is voluntary and that no one who does not wish to be a registered Service user is obliged to provide any data, but that providing data is mandatory under the Law on Obligations and the Law on Electronic Commerce, as well as regulations governing the registration of Internet domains, to exercise rights under these laws and regulations.
  • That the individual who has given consent for data collection and processing can withdraw their consent at any time without explanation, resulting in the cessation of Service use, the due date of all outstanding obligations arising during the Service use, and the cessation of further data collection from the individual who withdrew consent.
  • That in the case of unauthorized processing, individuals have the right to protect personal data and other rights granted by law.

Article 78

The data collected for the above purposes are:

  • First name,
  • Last name,
  • Address,
  • Phone number (mobile),
  • Email address,
  • IP address for each individual access to the service or Services (including “cookie” data).

Article 79

The user is obliged to inform Adriahost of any change in the provided data, or data necessary for successful communication, within 5 calendar days from the change. Otherwise, the user is responsible for all damage arising from inaccuracies, untruthfulness, incompleteness, or outdated data.

Article 80

Adriahost may, in accordance with the law, collect certain data about visits obtained during the use of the Service. These data can be used by Adriahost to improve its information society service, further direct and adapt it to visitors and Users.

Adriahost may, in accordance with the law, collect certain data about visits obtained during the use of the Service (so-called “cookie” data). “Cookie” data in the sense of this Policy refers exclusively to data related to the technical characteristics of the device used by the user to access the Internet service or Services, such as screen size, operating system, browser (Browser), and other data about technical characteristics. These data can be used by Adriahost to improve its Services and further direct and adapt them to users. Adriahost does not collect data about previous visits to other websites, searches, or other content or information that user or third-party “cookie” data may contain.

Article 81

In case of Service payment by credit card, Adriahost does not collect User credit card data. When entering credit card data, confidential information is transmitted through the public network in encrypted form using PCI DSS 3.1 standard, the most advanced cryptographic technology available. The payment process is guaranteed by the card payment processor, so the entire payment process is carried out on the provider’s pages. At no time are credit card data available to Adriahost or third parties.

Article 82

All general acts of Adriahost must comply with this Personal Data Protection Policy.

If any general act of Adriahost is not in compliance with this Policy regarding the protection of personal data, the provisions of this Policy apply.

XII – PAYMENT METHODS

Article 83

The prices of the services provided by Adriahost, as unique prices by packages, are listed in the Price List, which is considered an integral part of these Terms of Service and is published on the Internet address https://www.adriahost.rs/.

Article 84

When paying to Adriahost, the user pays the calculated amount according to the proforma invoice provided by Adriahost.

In the case of payment using Visa, MasterCard, and Maestro credit cards, the user pays the calculated amount while transaction costs (bank fees) are borne by Adriahost. Data security during purchase is guaranteed by the card payment processor. At no time are credit card data available to our system or Adriahost. The bank statement shows the text “Adriatek.”

In the case of payment using “PayPal” or “2Checkout” services, the payment processors process the transaction and direct it to the company Adriatek LTD, which is engaged by Adriahost. Such (pre)invoices bear the logo and business name of Adriatek LTD, as well as on the transaction statement: “2CO-Adriatek” or “Adriatek LTD.”

In the case of payment by card via Intesa bank and WS Pay platform:

Conversion Statement – All payments will be made in the local currency of the Republic of Serbia – dinar (RSD). For informational display of prices in other currencies, the middle exchange rate of the National Bank of Serbia is used. The amount charged to your credit card will be expressed in your local currency through conversion by the card organizations’ exchange rate, which is not known to us at the time of the transaction. As a result of this conversion, there may be a slight difference from the original price listed on our website.

User Privacy Protection – On behalf of AdriaHost, we commit to protecting the privacy of all our customers. We collect only necessary, basic information about customers/users and data necessary for business and informing users in accordance with good business practices and to provide quality service. We give customers the option to choose, including the decision whether they want to be removed from mailing lists used for marketing campaigns. All data about users/customers are strictly kept and available only to employees who need the data to perform their job. All Adriahost employees (and business partners) are responsible for respecting the principles of privacy protection.

Confidential Transaction Data Protection – When entering credit card data, confidential information is transmitted through the public network in encrypted form using SSL protocol and PKI system, the most advanced cryptographic technology available. Data security during purchase is guaranteed by the card payment processor, so the entire payment process is carried out in a secure environment. At no time are credit card data available to our system.

Refund Policy – In case of returning goods and refunding money to a customer who previously paid with a credit card, either partially or fully, regardless of the reason for return, AdriaHost is obliged to refund exclusively through Visa, EC/MC, and Maestro payment methods, meaning the bank will, at the request of the seller, refund the money to the cardholder’s account.

Article 85

Payment for the client’s service by any third party does not produce a change in ownership of the services or a change in the registered domain data (WHOIS data).

The change of ownership of services or registered domain data is made exclusively in writing through a ticket or memorandum of the legal entity, in accordance with these Terms of Service.

Payment for the client’s service by any third party does not result in a change of the client or client data.

Article 86

Adriahost reserves the right to change the Price List, with timely notification via the Internet and adherence to good business practices.

Article 87

The user pays the hosting service fee according to the proforma invoice issued by Adriahost for the hosting package they wish to use.

The user agrees to check the proforma invoice before payment to ensure that the hosting package is correctly listed, and if it is not, to notify Adriahost (also before payment) with a request for correction.

Adriahost will provide the service of the hosting package listed in the paid proforma invoice.

Adriahost issues an invoice and provides the hosting service only after receiving the full amount for that hosting package.

XIII – COMPLAINTS AND REFUNDS

Article 88

As Adriahost provides an information society service, complaints cannot be filed against the provided service.

Article 89

The information society service provided by Adriahost is fully completed because the service provision began with the user’s explicit prior consent to use the service, and by accepting these Terms, the user confirms that they are aware that they lose the right to withdraw from the contract once Adriahost fully fulfills its contractual obligations.

Article 90

Adriahost has no obligation to refund money for any service on any basis.

For domain name registration, SSL, dedicated server, and VPS services, no refunds are made.

Adriahost may, at its discretion, approve a full refund to the user provided that the user:

  • Requests a refund no later than 30 days from the proforma invoice issuance date, and
  • It concerns shared hosting and streaming services.

The user can choose to have all future invoices with the payment method “Credit Card” automatically paid when the due date arrives. This means that when the invoice payment date arrives, we will try to charge the invoice in full. If the user does not have sufficient funds on the card at that time, we will try again after 3 days and then once a week for the next 4 weeks.

With each payment attempt, the user will be notified by email, whether the transaction was successful or not.

The user can always disable automatic payment by selecting “Automatic Payment” in the user menu and clicking the “Stop Automatic Payment” button.

XIV – FINAL PROVISIONS

Article 91

For everything not regulated by these Terms of Service, the applicable regulations of the Republic of Serbia apply, excluding the application of conflict of jurisdiction rules.

These Terms of Service are a legally binding document through which Adriahost regulates its business operations and legal relations with Users.

These Terms of Service do not produce legal effects between Users and third parties,

nor can Users or third parties invoke these Terms of Service in their mutual contractual relations, nor does referencing these Terms of Service produce legal effects in mutual contractual relations between third parties.

Users providing information society services or other services must regulate their contractual relations with third parties independently, and under no circumstances can Adriahost be considered a party to such a relationship between the User and the third party.

Article 92

All disputes arising between Adriahost and the user regarding the use of the Service are subject to the applicable regulations of the Republic of Serbia. Adriahost and the user agree to attempt to resolve the dispute amicably, and if they fail, the Commercial Court in Belgrade is competent for resolving disputes with users who are legal entities and entrepreneurs, while the First Basic Court in Belgrade is competent for resolving disputes with users who are individuals.

Article 93

Adriahost does not mediate or participate in any dispute that may arise between two or more users, unless legally required as a necessary co-defendant.

If two users have not agreed otherwise, all disputes between two users regarding the use of the Service are subject to the applicable regulations of the Republic of Serbia.

Users agree to attempt to resolve the dispute amicably, and if they fail, the court competent for resolving disputes is determined by the general rules of assessing court jurisdiction.

Article 94

Adriahost reserves the right to modify or supplement these Terms of Service at any time by publishing the changes and supplements in a consolidated text on its website and sending a notification to all registered users at least eight days before their implementation.

If an already registered user does not explicitly respond within the specified period, it will be considered that they agree with the new Terms of Service. If an already registered user explicitly states that they do not accept these Terms of Service, it will be considered that their user status has ended, all previous rights and obligations cease, and the contractual relationship is terminated under the previous Terms of Service.

Article 95

These Terms of Service take effect eight days from the date of their publication on Adriahost’s website.

Article 96

Each printed copy of these Terms of Service produces full legal effect based on the provisions of the Law on Electronic Document and cannot be denied validity or evidentiary power.
